The President of Poland has signed an act amending the Polish Labour Code. The act introduces provisions partially implementing the DEU Pay Transparency Directive.
The new provisions impose on employers the obligation to provide candidates with information on:
- the proposed remuneration, its initial amount or the range of remuneration, determined on the basis of objective and neutral criteria, in particular taking into account gender equality;
- the relevant provisions of the collective agreement or remuneration regulations – if the employer is covered by a collective agreement or has remuneration regulations in place.
This information should be provided to the candidate in paper or electronic form:
- in the recruitment advertisement; or
- before the interview, if the employer has not announced the recruitment for the position or has not provided this information in the advertisement; or
- before entering into an employment relationship, if the employer has not announced recruitment for the position or has not provided this information in the advertisement or before the interview.
Importantly, the employer will be required to provide the above information in advance, allowing the candidate to familiarise themselves with it and conduct conscious and transparent negotiations.
In addition, under the new rules, job advertisements and job titles should be gender-neutral, and the recruitment process should be non-discriminatory, in line with the Directive.
There is also a clear prohibition on requiring candidates to provide information about their remuneration in their current and previous employment relationships.
The Act will enter into force on 23 December 2025. We await further information from the Polish government about implementation of the other aspects of the Directive.
